Non-Consensual Intimate Imagery Removal Policy

1. Scope

This policy covers requests to remove AI-generated intimate or sexual content that depicts an identifiable real person without their consent (Non-Consensual Intimate Imagery, or "NCII"), in compliance with the US TAKE IT DOWN Act (Public Law 119-7) and the UK Data (Use and Access) Act 2025.

2. Proactive Prevention

SIA Sigmatics employs technical safeguards to prevent our AI systems from generating content that depicts or resembles identifiable real persons. These include prompt-level filtering and output-level image analysis.

3. Reporting

If you believe AI-generated content on our platform depicts you or an identifiable real person without consent, you may submit a removal request:

Email: legal@myvirtual.love (subject: "NCII Removal Request")

Your request should include:

a. Your name and contact information;

b. A description of the content and how to locate it (if known);

c. A statement identifying the real person depicted;

d. A statement that the depicted person has not consented to the content;

e. If you are not the depicted person, evidence of your authority to act on their behalf.

4. Response Timeline

  • Acknowledgment: Within 24 hours of receiving a valid request
  • Removal: Within 48 hours of verification
  • Notification: We will confirm removal to the requester

5. Verification

We may request reasonable evidence to verify the identity of the requester and the depicted person before processing the removal.

6. Systemic Prevention

Upon confirmed removal, we will take steps to prevent regeneration of similar content, including updating our content filters.

7. Appeals

If content is removed under this policy and a user believes the removal was made in error, they may submit an appeal to legal@myvirtual.love within 14 days.

8. Legal Framework

This policy implements our obligations under:

  • The US TAKE IT DOWN Act (Public Law 119-7, effective May 19, 2026) regarding non-consensual intimate imagery, including AI-generated content;
  • The UK Data (Use and Access) Act 2025 (Section 138) regarding creation of intimate deepfake images;
  • The French Penal Code (Article 226-8-1) regarding AI-generated sexual deepfakes of real persons;
  • The EU Digital Services Act (Regulation 2022/2065) regarding notice-and-action obligations.
